The Oyo State High Court sitting in Ogbomoso has overturned the appointment of Oba Ghandi Olaoye as the Soun of Ogbomoso, following a legal challenge to his emergence as the traditional ruler.
Oyo State Government had announced Olaoye as the new Soun and installed him on September 8, 2023. However, before his installation, one of the contestants for the throne, Kabir Laoye, had challenged his eligibility in court.
Recall that the Oyo State Government announced Redeemend Pastor Ghandi Olaoye as the new Soun and made him king on 8th September 2023. The court ordered that the Oyo State government must not appoint anyone to the position, until after its judgement.
The legal dispute adds another layer to the often complex process of choosing a traditional ruler, where custom, eligibility, kingmakers and government authority can all intersect.
When a traditional throne is contested, who should ultimately have the strongest voice — the traditional institutions that choose the king, the government that recognises the appointment, or the court that interprets the law?
Where should tradition end and legal authority begin?
